Employee Provident Fund (EPF) : Retire as a Crorepati




We normally hate any kind of deductions in our monthly salary slips – either its income tax deduction , professional tax deduction or even an EPF deduction.Very few of us really know that this small EPF deduction each year can in reality make you a crorepati by the time you retire. Encouraging fact is that this statement is applicable to even with those having modest salaries. There’s many if’s and but’s to achieve that , most notably being resisting the temptation to withdraw money till retirement.

12% of your basic salary that gets deducted as part of EPF account every month has a potential to make you a crorepati by the time you retire. Most of us are of view that investment is so small and interest rate offered is nothing special. Power of compounding clubbed with a matching contribution from your employer every month can do wonders for you.

Encouraging stats : 8.5% interest earned on the EPF can help a person with a basic salary of 25,000 a month accumulate a mammoth 2.4 crore in 35 years. Sounds unbelievable.

Hard fact : A very few people are able to reach even 1 crore milestone in their careers.

Good news is that the initial draft of Direct Tax Code has proposed that new contribution to EPF be taxed on withdrawal. However , the revised draft has made EPF fully tax exempt making it once again one of the best debt option available in the market.

Try not to touch your EPF account till you hang your boots. You may have to use it during acute emergencies but other than that avoid poking into this account while you are working. Its not uncommon of people to withdraw their PF at the stage. Government discourages you to withdraw money as withdrawals from EPF within five years of joining are taxable. Early withdrawal don’t allow power of compounding to come to play.

Lesson for everyone – Do not withdraw money from EPF while switching jobs , one should transfer the balance to the new account with the new employer. Remember , this do not happen automatically. You need to fill a ‘Form 13′ and deposit it with the EPFO. Make this one of your first TODO’s things at new workplace as with course of time you will loose track of it and also get pre-occupied at new job.

EPFO in addition is coming up with a software enabling online transfer of money from old account to new account. This will reduce both the paperwork and time taken for transaction

Postal Dept works towards Bank Permit

The department of posts will formulate a detailed project report for setting up a bank, in the XII Plan.

“The postal department has already conducted a study and has found that the proposal is feasible. DPR (detailed project report) is the next step to chalk out the exact blueprint for the model,” a senior official from the department of posts (DoP) told Business Standard.The department will apply for a banking licence from the Reserve Bank of India. Post Bank of India may be set up with the required authorised capital of Rs 700 crore, the official added.“The plan is to offer banking services in rural and semi-urban areas by converting our post offices into banks. The department has about 1.5 lakh post offices across the country, which is mainly located in rural areas,” a source said.The department also operates the Post Office Savings Bank, where it has over 240 million savings accounts. It has a customer base of over 23.75 crore with an outstanding balance of Rs 6,19,611 crore as on March 31, 2011.
The postal department offers schemes such as savings account, recurring deposit, time deposit, monthly income account scheme, postal life insurance, public provident fund, Kisan Vikas Patras and National Savings Certificates.The feasibility report has already laid out ownership, capital and organisational structure, as well as new product and services to be offered, among others.According to working group report for XII Plan, the demand for rural banking is particularly high with only 39 per cent of households covered by institutional banking. Globally, postal organisations have transformed financial services into banks successfully. The global firms include Deutsche Post Bank, Japan Post Bank, Kiwi Bank, La Banque Postale (France).The department is also focusing aggressively on its postal life insurance product. According to the information with the postal department, the department has about 5 million policies under postal life insurance with an assured amount of Rs 58,132 crore, while under rural postal life insurance; it has about 13 million policies with an assured amount of Rs 67,162 crore.The PLI has been clocking an average growth rate of 32 per cent in terms of premium income while the growth rate of RPLI stood at 60 per cent in terms of premium income in 2009-10 over the previous year.

Subject:- Clarification regarding default fee in RD and calculation of Post Maturity Interest.



Sir / Madam,


The undersigned is directed to refer to this office letter of even number dated 13.12.2011 (SB Order No.31/2011) and Corrigendum-I issued on 20.12.2011 and Corrigendum-II issued on 02.01.2012 on the subject. This office is still receiving phone calls regarding charging of default fee in RD from 1.1.2012 under modified rules and calculation of PMI. Following further clarifications are issued on the subject:-


In case of RD



Since the rule of default fee and the software have not been amended, no default fee is to be charged if the above rule is not followed till the rule and software is amended. Default fee provision will remain the same. This rules has been got modified to avoid rush of RD work in the last week of a month. Amendment in the rule for charging default fee shall be taken up with Min. of Finance once the work of putting stamps on all the RD Passbooks is completed and depositors become familiar about the change.

In case of PMI

It is further clarified that PMI is to be calculated for the complete month from the date of maturity and remaining part of the month is to be ignored. Revised example is given below:-

if an account was matured on 26.8.2009 and the depositor attends the post office on 30.01.2012, he/she will be paid PMI at the rate 3.5% from 26.08.2009 to 25.12.2011 (28 complete months) and at the rate 4% from 26.12.2011 to 25.01.2012 (one complete month). Period from 26.1.2012 to 30.1.2012 (being part of month) will be ignored.

1. Vision, Mission and Policy goals of the Postal Sector in India.
Vision
􀂙 The postal sector/ industry as a whole should evolve a common vision, which
is in sync with the overall economic goals of the country and the national
development agenda.
􀂙 The Postal Sector needs to be defined, so that the Sectoral Vision and
Mission can be evolved. In broad terms, the Postal Sector is coterminous
with the Courier, Express, Parcel and Logistics (CEP&L) industry.
􀂙 The Vision of the sector/ industry should be aimed at facilitating its own
growth and development on the one hand and enabling it to contribute to its
full potential to the national mainstream on the other.
􀂙 The sector should aim to be the common man’s window to the world. The
vision for the sector should therefore capture the objective of being a
facilitator to the residents of the country participating in the mainstream
socio‐economic theatre.
􀂙 The vision should also take note of the three dimensional mandate of the
sector i.e., being a channel for moving information, goods and money.
􀂙 The sector should aim to be sustainable, non‐exploitative, open to
competition, and self‐sustaining.
Mission
􀂙 The Mission for the postal sector will delineate who is the user (or
customer) of postal services, what services will be provided to that user
and what would make these services unique or essential to the user.
􀂙 The sector should aim to cater to the entire population, across all ages,
classes and geographies
􀂙 Reliability, efficiency and security of the services will be its principal
objectives
􀂙 Postal services will seek to integrate technological innovations to maximize
its objective of ensuring the economic and social connectivity to all residents
of the country.
􀂙 Introduction of innovative services like hybrid mail and electronic
documentation services.

􀂙 Postal services should be viewed as a tool of development, enabler of
commerce and facilitator of achieving the aspirations of the people.
National Goals for Postal Services
It would be worthwhile to frame a set of national goals for provision of basic
postal services to the residents of the country. These goals will be set from a
national perspective, and not the industry perspective. They can form the
foundation of the National Postal Policy. The issues which the national goals
can address are:‐
‐ Right to access to a specified range of services to be available to all
residents with specified quality parameters and at affordable prices.
‐ Non‐discriminatory prices and policies.
‐ Evolving common standards for the industry/ sector.
‐ Development of the sector as an enabler of socio‐economic progress.
‐ Protecting the interest of the users (customers).
‐ Protecting the interests of the employees and to ensure that the
practices followed by the operators are non‐exploitative.
‐ Promoting investment, private enterprise and fair competition in the
sector.
‐ Promoting creativity, innovation and entrepreneurship, while
promoting micro, small and medium enterprises in the sector.
‐ Developing a national address system; to be recognized as a national
asset.
Policy
􀂙 The Sectoral Policy should recognize the right of every citizen to access to
basic postal services at all locations and covering all sections of the people.
Solutions to meet the special needs of the under‐served groups and areas
should be a major sectoral policy objective.
􀂙 Universal postal service should be recognized not as an unwanted
‘obligation’ but as a legitimate vehicle to further the country’s development
needs on the one hand and popular aspirations on the other.
􀂙 Protection of interests of customers in the Postal Sector: It should be
examined whether any dedicated mechanism is needed or existing systems
like those under the Consumer Protection Act, 1986 are sufficient.

􀂙 To see if existing legal frameworks and safeguards adequate for ensuring fair
and sufficient wages, and just and humane working conditions for the
protection of employees.
􀂙 Improvement of quality of services and provision of new services to meet
emerging demand.
􀂙 Evolving uniform standards and adopting new technologies.
􀂙 Acceptance of the principle that tariffs should be non‐discriminatory and
related to costs.
􀂙 Prescribing implementation mechanism for the National Postal Policy.

2. USO of the Postal Sector
􀂙 The challenge of providing efficient and effective basic postal services at
affordable price to all sections of the population over all geographies.
􀂙 The essentiality of basic postal services – the growing socio‐economic
needs of the country.
􀂙 Defining universal postal service as a legitimate vehicle to further the
country’s development needs and popular aspirations.
􀂙 The definition of USO not to blindly follow developed countries’
prescriptions, but to take note of the Indian reality.
􀂙 The universal service provider(s) to be identified based on relevant
criteria to be developed from the outcome of discussions.
􀂙 Financing of the universal services to be transparent.
􀂙 Options for financing the USO – state funding, reserved area
(monopoly), creation of contributory USO Fund.

3. Organization and Market Research , environmental concerns and social
responsibilities in the Postal Sector
􀂙 Collection and Dissemination of Information on Industry Methodology for
Market Research
‐ A coordinating body which carries out functions like market survey
and market research on behalf of the different players in the Postal
sector and readily accessible to all. The body should draw on
expertise from representative stakeholders of the Postal sector and
its findings, research reports, data, studies etc. should not be
interest‐driven but should be able to be reliably depended upon for
their factual content and impartial perspectives. It should also be the
repository of database of best industry practices. A major challenge
would be funding such a body.
􀂙 Firming up Industry Standards of Services/Products in the Postal
Sector.
‐ Industry standards on service delivery should be drawn up. This may
include service standards on delivery, provision of proof of delivery,
track and trace, customer grievance redressal, compensation for
below standards of service delivery
‐ Definitions of products and services should have uniform applicability
and should be legally enforceable.
􀂙 Environmental Concerns
‐ The postal and courier industry is almost entirely dependent on
paper and paper products. Consumption of paper has an adverse
impact on the environment. It is advisable to use technology in a big
way to minimize the use of paper. Hand held devices, SMS, emails
and paperless administrative work are some of the means that can
be used to reduce consumption of paper.
‐ Postal sector uses large amounts of packaging material like bags,
trays and seals. These items are often made of plastics which have
adverse impact on environment. Traditional material like jute and

other biodegradable substances should be encouraged for use by the
postal and courier industry.
􀂙 Corporate Social Responsibility (CSR):
‐ Should corporate social responsibility include Universal Social
Obligation which is now being served and funded exclusively by
Government of India?
‐ Defining ethical practices in the Postal Sector which may include fair
and equitable pricing for specified services and products, customer
rights to transparency, redressal of complaints etc., protection of a
basic set of employee rights and entitlements
‐ Other aspects of Corporate Social Responsibility like spending money
to derive social benefits for the nation may be in the form of
education of the consumers and bringing greater awareness about
the postal sector and value added services.

4. Expansion and Modernization of Postal Network in India
Scope
‐ The Postal Network should be leveraged for a broad range of retailing,
delivery of Government Schemes, promoting financial inclusion and socioeconomic
equity.
‐ The extensiveness of the network particularly in rural areas, which lack any
other similar network capital, and rich experience of postal personnel in
functional areas besides mails and parcels opens new opportunities
improve in business and revenues outside the traditional postal operations.
Expansion of Network
‐ Consumers’ needs and demands from a postal network should be central to
the issues of expansion and modernization of postal network. The postal
networks should be expanded and modernized in such a way that it results in
the better access of postal services to consumers while also improving the
revenues for the networks.
‐ Policy concerning postal networks for urban areas should be in tune that the
expansion policy of a particular urban area.
‐ Efforts should also be made to link different local and community institutions
such as Aanganwadis and people’s collectives including SHGs with the Post
Offices.
Utilization of network
‐ To ensure that postal networks are optimally used to the benefit of the State,
Government structures at all levels viz. central, state and local may make
optimal use of the postal infrastructure for the rendering of their services and
may include Government to citizen cash transfers, electricity bill payments, tax
collection on behalf of local/State/Central Governments, collection of license
fees payment of pensions and various social security payments.

‐ Such mandates will not only benefit the recipients and the Government
agencies concerned they will also generate revenues for postal networks thus
reducing their dependence on USO subsidies for meeting the USO obligations.
‐ Efforts should be made to engage postal networks in all aspects of ecommerce
backed by appropriate technology.
􀂙 Modernization of network
‐ It is inevitable that communications technology will continue to advance and
those in the communication business will have to move to electronic means
The postal networks will therefore need to consider having technological
partners to assist in implementing and maintaining the communication
networks that will be needed.
‐ There should be minimum technology standards across postal industry for
quality of service delivery. Areas for such standardization may inter alia
include track and trace of letters, electronic acknowledgments, faster
transmission of postal goods, and faster and wider dissemination of
information.
‐ Rural postal networks need to be significantly strengthened by using modern
technology.
‐ Rural postal personnel need to be adequately trained for using such
technology.

5. Issues relating to Standardization of mail and National Address System.
Strategy
Standardization of mail
‐ Standards should be laid down with respect to size, addressing, preparation
of packages, choosing a specific mail product or value addition to an existing
product.
‐ Size of the letter mail should be made specific as per the requirement of the
customers and processing of the same through machines.
‐ The weight of the letter mail needs to be decided vis‐a‐vis its size.
‐ Product designing requires attention depending on customer requirements
and the type of product and service they require
‐ The quality of stationery use for the mail should be standardized keeping in
view the ease of processing, safety of contents and handling of the same
through machines.
‐ Use of PIN code should be made a part of the address.
National Postal Address
The format of Postal Address may be standardized as follows‐
• Addressee name
• Premise number/ name
• Sub Locality‐street/Colony
• Locality name
• City/town
• State‐PIN code
‐ Numbering pattern of houses in old localities need to be rationalized. If
numbering is not on the basis of a plan, stakeholders should be asked to
revise the numbers.
‐ In future planning, all civic bodies/ town developers must obtain NOC from
Department of Posts to plan town/colony as per standard Postal Address.
‐ Community Letter Boxes may be made compulsory in multi‐storeyed
buildings and number of house may be given to letter box concerned. Town
planning agency will have to be involved in this area.
􀂙 National address database along with a digital street directory needs to be
created

6. Issues relating to development of institutional framework with right and
responsibility of Government regulator, operator and customer .
􀂙 The legislative framework for the postal sector should enable and
strengthen healthy and balanced competition in products and services
and facilitate multiple service operators thereby providing the
customers their right to exercise a choice of operators.
􀂙 Keeping in view the unorganized nature of postal sector business
existing as of now, the policy formulation and the legislative framework
should not be a deterrent to the operations of small and medium
couriers who should be enabled to be serve customers with greater
efficiency and responsibility.
􀂙 The issues regarding universal services obligations should be clearly
delineated. The USO product/services and characteristics of these
products/services should be defined.
􀂙 Would there be a requirement for multiple USO operators in the sector
and if so how this should be managed?
􀂙 The implementation process for unorganized sector as well as organized
sector and the monitoring instrumentalities/framework will be an issue
which will require a suitable monitoring mechanism.
􀂙 Need for a regulator, if any and the role and responsibilities which
should take into account the nature of competition that prevails in the
sector, the socio‐economic concerns of the citizens of this country and
the direction in which this sector should progress in the future.
􀂙 The scope for future technological developments and intra sectoral
linkages should be examined and formulated to ensure excellence in
customer service delivery at equitable prices with maximum
transparency and responsibility.

􀂙 The pricing strategies and man power issues are to be addressed both
for USO and non USO services.
􀂙 The need to bring operators under the Consumer Protection Act since
they offer competitive services. Competition should drive the price of
the products/services where they are not offered as part of USO or
governance related programmes.
􀂙 A code of conduct should be prescribed for the sector which will
prescribe ethical work practices and procedures.

7. Contours of Competition Policy in the Postal Sector
􀂙 Postal Sector can be divided into two parts – commercial sector and
sovereign functions aimed at providing social service. While
protection under the sovereign function is acceptable, there is no
protection that can be claimed for commercial activities. The
commercial activities are open to competition to all the players in
operation.
􀂙 The primary focus from the point of view of implementation of
competition law is that concerns of the consumers must be
protected at all costs.
􀂙 No player should have monopoly and there could be level playing
field for all the players in the postal sector. While there may be
dominance of a particular player in the market but the dominance
should not be abused.
􀂙 There should not be any cartel formation among group of players in
the postal sector to the detriment of customer interests and healthy
market driven competition.
􀂙 Equal treatment to all players‐ the commercial sector.

8. Issues of strategies relating to capacity development in the Postal
Sector Network collaboration and strengthening, developing R&D
resources and modalities for shared infrastructure, intra‐sectoral
cooperation leading ultimately to better and wider range of
services/products at affordable prices.
The Postal Policy needs to focus on the following areas relating to
Capacity Development in the Sector:
Rules and Regulations
􀂙 Conditions of registration of all operators will involve
adherence to quality standards, providing relief to the customers in
case of any deficiency in service, commitment to ensure
confidentiality and security of the article received for delivery and a
grievance redress mechanism.
􀂙 A mechanism needs to be developed to ensure minimum
wages and other similar legislations to be followed by all the
registered operators.
Developing Human Resources
􀂙 The employees are required to be sensitized to minimum
expected standards of service in the sector, focusing on the needs of
the customers and need to be trained at regular intervals. The
infrastructure for such training is required to be developed for the
Sector as a whole.
􀂙 The sector needs to develop customized training programmes
of short, medium or long duration by identifying sector specific needs
as well as emerging needs.
Leveraging the Last Mile Advantage for Delivery
􀂙 There is scope for increased cooperation between the multinational
operators and India Post in the field of cross‐border mails,
parcels and logistics in a structured and transparent fashion, based on
commercial terms agreeable to all parties. This will ensure the last mile
advantage for delivery even in the remote, inaccessible and not so
profitable areas.
Sharing the Infrastructure

􀂙 Need for higher cooperation among various operators of the
Sector in sharing the transport & warehousing infrastructure and to
reach to a win‐win situation.
Access to the Customers
􀂙 The various operators of the Postal Sector can enter locally into
structured arrangements with each other keeping in mind the increase
in access that they need to give to the public to their services, without
sacrificing the commercial considerations.
Cooperation in the State‐of‐The‐Art Technology
􀂙 Development of Sector specific Software and its implementation is
another area where cooperation between the various operators is
possible in developing the capacity for the Sector as a whole.
Market Research and Development
􀂙 There is need for higher cooperation among the operators in
dissemination of information relating to market research and sharing of
information by all concerned.
Institutional arrangement for sharing of best practices
􀂙 There is a need for an institutional arrangement for sharing of best
practices amongst various Government and private operators in order
to be able to develop the sector of Postal communication as a strong
service industry.

9. Synchronization of domestic postal policies with WTO and other
international norms:
Role of Postal Sector in promoting international trade
and mutual benefits arising thereof, implications of WTO regime w.r.t
opening of markets, re‐mailing and arbitrage, MFN clauses, Free Trade
Regimes. The market access and other WTO modes are to be seen in
consonance with UPU conventions while formulating the legislative
framework.

10. Roadmap for the Postal Sector
Trends:
Mail volumes characterized traditionally by individual communication, have
witnessed progressive decline over the last decade. At the same time, more
than 2000 small and big private players operate in this segment in the
country. The Indian Courier, Express and Parcel (CEP) market accounts for
EUR 1 billion and has been growing with a Compounded Annual Growth Rate
(CAGR) of over 20% per annum. There are approximately 2 crore internet
users in the country. Increased internet penetration is likely to give a major
fillip to e‐commerce related services in near future. Improved infrastructure
in the country would propel the Logistics Sector.
Growth Strategy:
In the changed context, both public as well as private operators will have to
provide a quality driven and value added proposition to the customers. The
players and stakeholders will have to work on the following areas:
􀂙Harmonious and conducive environment for all operators combined with
the commitment towards universal service obligations for providing basic
communication needs to every citizen of the country at an affordable and
easy‐to‐reach out environment, especially in the rural areas. This may
require an independent regulator in the postal sector which needs to be
examined.
􀂙 Sharing of networks: Different operators could join hands to share
each other’s network to provide an extensive customer interface, line haul
and delivery mechanism across the country.
􀂙 Transportation Infrastructure: The success of CEP players depends to
a large extent on the efficacy of a robust air‐cum‐road‐cum‐rail network in
the country. Service providers such as airlines, Railways, Road transport
service providers have a crucial role as enablers of time‐bound
transportation of documents and merchandize. The role of Airport Authority
of India, private players managing airports, ground handling agencies is also
very important in developing a synergy between different players involved in
air transportation.

􀂙 IT infrastructure: E‐commerce is primarily driven by a solid IT
infrastructure in terms of customer interface, inventory control and an endto‐
end tracking mechanism. Creating and sustaining a robust IT backbone in
terms of internet connectivity and software solutions is of paramount
importance. Therefore, role of internet service providers and software
development firms would be critical for the success of the e‐commerce
platform built by the CEP operators. The quality of internet/ broadband
connectivity, especially in smaller towns and rural areas needs to be
improved substantially. On the other hand, availability of cost effective and
durable IT hardware with the operators is equally important in making the
services economically viable.
􀂙 Secure payment systems for online users: Developing a secure
payment system for online users will be an important factor in the growth of
e‐commerce in India. Online frauds and breach are the biggest barriers to
online sales in the country. Therefore, enhanced cyber security mechanisms
need to be put in place to safeguard against online frauds. Since use of
credit/debits cards online is still limited in the country, a well developed Cash
on Delivery (COD) payment system (riding on online orders) needs to be
developed.
􀂙 Warehousing and Inventory Control: The ability to cater to the
demands of the customers placed on the e‐commerce portal would depend
upon building an extensive chain of warehousing and managing the
inventory.
􀂙 Secure and reliable transportation and delivery mechanism: The
continued growth in the logistics and e‐commerce should be complemented
by a secure, reliable and time‐bound delivery mechanism on part of the
service providers. Secure and safe delivery of consignments is a pre requisite
for efficient and reliable postal network. Proper security mechanisms to
ensure safe delivery have to be developed across the industry.
􀂙 Diversification and redesigning of product portfolio and developing
a new pricing strategy commensurate with competitors’ pricing and the need
to build in requisite flexibility for different customer segments.
􀂙 Department of Posts, with the largest postal network in the world,
has an ideal infrastructure for distribution of retail and e‐commerce (goods
and services). Besides, the extensive network of post offices across the
country is ideal for:

􀂙 Distribution of social and economic welfare programmes
􀂙 Retailing needs of SMEs
􀂙 Bulk mailing needs (documents, policies, premium notices, cards,
mailers, campaign material etc.) of corporate business houses (banks,
financial service providers, direct mailing companies)
􀂙 Increased role in information dissemination for farmers, health
centers, schools etc. Private service providers may join hands with India Post
for leveraging this distribution network.
􀂙 The growth in International business and increased inflow and
outflow of goods and commodities requires simplified processes relating to
customs clearance. An electronic interface between India Post, other players
in the CEP market, airlines and Customs need to be developed to facilitate
faster handling of cross border goods.

The members of the National Sectt. of the Confederation available at Delhi met today and decided to launch a campaign to elicit the full participation of Central Govt. Employees in the 28th February, 2012 general strike being organized jointly by all the Trade Unions in the Country against the Government’s Economic policies. It is decided that the National Sectt members must be the observers in the campaign meeting at various Stations. Appended to this Circular is a list of stations where the meetings are to be organized. The comrades whose names are indicated against each station will make arrangements for visiting those places on the specified dates. Arrangements for the stay of the visiting comrades will be made by the respective State Committees.

The Secretaries of the State Committee will convene a meeting of the members of the affiliates on the specified date. It must be ensured that the State/ Circle Executive members of each affiliate is present in the said meeting apart from other members. Ensure that large number of members attend the meeting. It must be made mandatory that the members of the Managing/Executive Committee do attend the meeting without fail.
We send herewith draft Strike notice addressed to the Cabinet Secretary, which would be submitted to him by the Confederation CHQ. Similar notices will be prepared and submitted by each affiliate to their heads of Department or Secretary to the concerned ministry as the case may be. On 10th February, 2012 demonstrations will be organized in front of all Offices with full participation of all members and the concerned Secretary will hand over a copy of the notice submitted by the affiliates to their heads of Department. The affiliates will submit the notices on or before 5th February, 2012. Confederation CHQ will serve the strike notice on the Cabinet Secretary on Ist February, 2012.

8) Remove the ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.

9) Scrap PFRDA Bill/New Pension Scheme; Ensure pension for all.

10) Compulsory registration of trade unions within a period of 45 days and immediate ratification of ILO conventions 67 and 96.

1. Stop downsizing, outsourcing, contractorisation, coporatorisation and privatization of Governmental functions

2. Fill up all vacant posts and create posts on functional requirements

3. Revise wages of CGEs with effect from 1.1.2011 and every five years thereafter.

4. Regularize the GDS, daily rated workers, contingent and casual workers by brining about a definite scheme of regularization.

Settle all items of anomalies (including the MACP related anomalies) raised in the National and Departmental Anomaly committees within a fixed time frame of two months; set up the anomaly committees in those Departments where it has not been set up till date with the Standing Committee members of the National Council; convene the meeting of the Departmental Council in all Ministries/Department once in three month as envisaged in the JCM Scheme

Make the right to strike a legal right and stop curtailment of T.U. rights

Implement all arbitration awards

Raise the interest rate for GPF. Revise the OTA and Night duty allowance and stitching and clothing rates of uniforms

Merge DA with Pay for all purposes including pension as and when the DA rates croses the 50% mark.

Vacate all Trade Union victimizations.



MEETING WITH MINISTER



Meeting with Sri. Sachin Pilot, Hon’ble Minister of State of Communications, was held today (21.01.2012) at 11.00 AM. Meeting lasted for 30 minutes. The staff side presented a memorandum to the Minister, containing the issues which needs Minister’s intervention. (See the copy published in the website). Minister agreed to examine each case on its merits and take early decision. The following issues were discussed with the Minister, in detail.

Regarding GDS issues like status, promotion etc. Minister assured to examine the cases in detail and taken a decision at the earliest. Regarding reduction of existing allowances of GDS, the Minister gave on the spot instructions to the Secretary, Department of Posts, to issue orders protecting the existing TRCA in full. Further regarding cash handling point Minister directed Secretary that it should be finalized before 31st January 2012. He assured that the other issues like Bonus ceiling, providing norms for left out items etc. will also be given sympathetic consideration. Regarding casual labourers issues Minister gave direction to the Postal Board to expedite the orders. Minister further assured that he will definitely call for the files relating to the other items mentioned in the memorandum and an indepth examination of the issues will be made and decision taken early.

The following long pending issues of the three lakhs Gramin Dak Sevaks may kindly be considered favourably.

<!--[if !supportLists]-->(b) <!--[endif]-->25% outside quota recruitment in Postmen promotion may be withdrawn.

<!--[if !supportLists]-->(c) <!--[endif]-->Enhancement of Bonus ceiling to Rs.3500/- at par with regular employees.

<!--[if !supportLists]-->(d) <!--[endif]-->Revision of tightened norms for cash handling etc.

<!--[if !supportLists]-->(e) <!--[endif]-->Stop reduction of existing allowance (TRCA) and grant full protection.

<!--[if !supportLists]-->(f) <!--[endif]-->Review of the tightened norms for compassionate appointment.

<!--[if !supportLists]-->2. Grant of Minimum Pay to the casual labourers working in postal department and regularization.

Despite crystal clear orders in existence to grant the minimum of Group ‘D’ Pay on pro-rata basis to the casual labourers as per the Sixth CPC report, it has not been extended so far to the casual, part-time, contingent employees working in the Postal department. There is an inordinate delay in releasing the orders. In all other departments pro-rata payment has already been made in the year 2008 itself. Notwithstanding the implementation of the recommendations of the committee on casual labour issues constituted by the Postal Board, it is requested to cause immediate orders to pay the minimum of the pay to the casual labourers w.e.f. 1.1.2006. Action may also be taken for regularization of the service of casual, part-time, contingent employees.

3. Regularization of RTP Services and ending the discrimination between the restwhile RTPs

(i) As per the Directorate letter dated 19.4.96, the implementation of the Ernakulam CAT judgment granting the past RTP service as regular service for all purposes was restricted only to the applicants of the O.A. This is against to the decisions of the various judicial pronouncements that the benefits should be extended to the similarly situated persons.

(ii) During 1970 to 1974, even the pre training services of certain officials engaged as postal clerk were regularized. The RTPs were trained and utilized full time in the clerical posts to manage all the works of the post office. They were recruited only under the Postal Assistant recruitment Rules and no separate recruitment rules were framed at this time.

(iii) The CAT, Chennai held that the services rendered by the ex RTPs at APS shall be counted as qualifying services for all purposes. The Chennai High Court, on appeal by the department has upheld the decision of the CAT in WP no 37117 to 37119 of 2002 and directed the department to extend the benefits. Based on this the service rendered by RTP was regularized for several APS RTPs.

(iv) In another case, the Apex court under Civil Appeal No.5739 of2005 filed by Sri M. Mathivanan, Postal Asst, Cuddalore division upheld the decision of extending the benefits and dismissed the appeal filed by the department with costs. Several APS RTPS were regularized based on this also.

(v) The Directorate has directed the Circle Heads to collect, compile and furnish details of ex-RTPs deputed to APS to consider for extending the benefits to all similarly situated persons. There after there is no action in this regard.

(vi) The Mumbai High Court has also delivered favourable judgment in this regard on 31.8.2010.

(vii) When the issue was earlier taken up through the Minister of State by our union, the department has called for the particulars about the RTPs from all circles vide its letter no 44-1/2011- SPB II dated 13.01.2011.

(ix) We are not demanding the wages for the past periods and only seeking the service be taken for promotion. This will not affect any one’s seniority since during 1983 to 1989, there was no recruitment due to ban in filling up of vacant posts. By construing their service, they will get their LSG and other promotions earlier which will not have any financial benefits to them since all of them, by that time will be in Pay Band II. If their services of RTP are taken for MACP, they will get some monetary benefits for which also there is no provision in the existing rules.

Since this will not have any financial implications, it is requested to kindly consider the same without sticking to the Apex Court judgment issued in 1986 in different context in this case by brushing side the bare facts of justification and other subsequent judgments.

4. Creation of System Administrators cadre & extend other facilities

A rapid modernisation takes place in the department and around 1872 crores have been allotted for further extension of modernization. To modernize the existing Post offices, the role of the existing System Administrators are laudable. They are working from dawn to dusk for the efficient functioning of Pos in computers. But for their active involvement, the modernization of Postal Services could not be possible without incurring any expenditure to the department in the initial stage. Most of the softwares were developed by these section of employees. Now the Department is stating that creation of system Administrator posts is not viable. We have already dropped the demand of creation of System Administrators which carry 5400 Grade Pay as there is no full time justification for such post. ‘System Assistant’ cadre with Grade Pay of Rs.4200/- is in existence in other Government departments. Similar kind of System Assistant cadre may please atleast be created in the department and all the existing personnel may please be absorbed in the existing vacancies since the role of these Technocrats are very much essential for the maintenance of computers & software.

<!--[if !supportLists]-->5. Revision of OTA rates and stop recovery of OTA paid to the officials who are engaged compulsory on OTA overlooking the pay ceiling.

At present, over time Allowance is being paid at the rate of Rs.15.85 per hour which was fixed by the Fourth Pay Commission in 1987. There was to revision eventhough the committee of secretaries to look into the OTA issue has decided to continue the scheme of OTA without revising the rate of OTA. In the Railways the rate has already been revised. Further the pay ceiling as fixed by 4th CPC as Rs. 2200/- P.M. has not also been revised. As per the new pay, almost all crossed the ceiling amount and they have been ordered to perform OTA compulsory and in many cases they have been charge sheeted for not performing OTA. The meager amounts paid at the rate of Rs. 15.85 has also been recovered subsequently. In all the departments, except Postal, the OTA rates have been revised.

It is therefore requested to kindly cause action to revise the OTA rates and waive the OTA amount already paid based on the duty performed due to unscientific application of OTA ceiling fixed by the 4th CPC.
<!--[if !supportLists]-->6. <!--[endif]-->Grant of cash payment for uniforms and kit items for Postmen, Mailguard, MTS/Group ‘D’

At present the quantity of the uniform supplied is not good. Abnormal delay is also taking place. Action may be taken for cash payment for uniforms and kit items.

<!--[if !supportLists]-->7. <!--[endif]-->Delay in filling up of vacancies in all cadres especially in Postal civil wing and Postal Accounts and Postmen cadre.

<!--[if !supportLists]-->(a) <!--[endif]-->Eventhough Government has lifted ban on filling up of vacant posts in 2009 iteself, the recruitment process for filling up of vacant posts in civil wing and Postal Accounts are yet to be completed. Postmen posts are also lying vacant due to non-conducting examination. Action for filling up vacant posts in their cadres may also be expedited.

It is requested to kindly extend the benefits already provided to RRR candidates of Tamilnadu circle to the similarly situated candidates, They are praying mercy and fair play from the Minister as they are being continuously engaged over 14 years and there is no chance for any employment at this stage.


10. Convening the 11th Meeting of Postal Service Staff Welfare Board

The Hon’ble Minister of State for communication & IT has fixed to 11th meeting of postal services Staff Welfare Board on 05.04.2011 for discussions on 27 items in the agenda which was subsequently postponed. Almost all the items placed in the agenda are pertaining to the welfare of the staff. We request the Hon’ble Minister to convene the meeting and decide the items as notified in the agenda as welfare measure to Postal staff.

<!--[if !supportLists]-->11. <!--[endif]-->Counting of Special pay to PO & RMS Accountants on TBOP promotion

For implementation of High Court, Karnataka judgment in W.P. No. 7593/2003 dt. 18.11.2010 on this issue, the Ministry of Law has opined that this is not a fit case by way of filing SLP before Apex Court. However, the Directorate has sought the opinion from all circles about filing SLP against Karnataka High Court orders. A kind attention is drawn to order 1 of Appendix 8 of FR & SR 1 which is stated inter alia: -

“The Special Pay would henceforth be termed as Special Allowance as recommended by 5th CPC in para 109.5 of the report and would be granted as hitherto fore subject to same conditions as are stipulated in FR 9 (25)”

(Dept of per & Trg OM No. 4/4/97-Estt (Pay II) dt. 22.4.1998)

The Karnataka High Court has upheld the order of Ministry of Personnel granting special Allowance subject to the same conditions of special pay vide FR 9 (25). In the Draft memo circulated by Directorate to all Heads of Circles seeking their opinion, the following are not reflecting the facts of the case.

<!--[if !supportLists]-->i) <!--[endif]-->In para 6, 3rd line it has been mentioned that “special pay having been converted into special Allowance” ….. Whereas in Government order, “as per recommendations of 5th CPC, special pay has been termed as Special Allowance.”

<!--[if !supportLists]-->ii) <!--[endif]-->In para 6, 9th line, it has been mentioned that “Payment of special pay was completely stopped,” – but the stoppage of special pay was not accepted by Govt. As per Vth CPC recommendations, the Special pay is now termed as Special Allowance and would be granted as hitherto are subject to same conditions as are stipulated in FR 9 (25)

Under these circumstances, it is not fair to move with SLP in this case as the DOPT vide its OM dated 22.04.1998 clearly stipulated that the special pay was now termed as special allowance subject to the same condition and as such the problem of pay fixation by taking Special Allowance can be sorted out.
It is therefore requested to kindly implement Karnataka High Court decision to all the similarly situated officials and render justice to the aggrieved officials.
<!--[if !supportLists]-->12. <!--[endif]-->Recovery of alleged overpayment of pay and allowances to postman on account of fixation from the officials of Accounts branches of HPOs

The drawing & disbursing officers should not be made as scapegoats in this case. According to Rule 87 of P&T FHB Vol I, any excess payment can be recovered at any time. The Apex Court also confirmed that any excess paid due to administrative mistake, there is no rule which prohibits such recovery (Udaysankaran Vs. Union of India JT 1996 (4) SC). The most pertinent point is that the Inspection Parties of ICI and Audit have approved and certified such drawal in many places. There was confusion in interpreting the orders then for which Group C officials are becoming the victims.

On 13.1.09 The Secretary (P) assured to reconsider the issue and ensure no recovery on part of APM Accounts & Accountants. The Secretary observed as unfortunate in the case of Rule 14 initiated charges on the date of superannuation of Sri. V. V. Nargida, APM, Accounts Pune city as he did not pay Rs.727671.61 towards contributory factor for excess drawal to postmen on implementation of 5th CPC orders.
Instead of filing SLP against the decision of the principal CAT, the department has resorted to imposing recovery on APM Accounts and Accountants for the excess drawal resultantly, many officials were charge sheeted and lakhs of rupees is being ordered as recovery. This is totally unjust and against to the natural justice. The Secretary during the talks held on 10.01.2012 has agreed to consider the issue on humanitarian angle.
It is therefore requested to kindly protect the innocent officials from the recoveries arbitrarily imposed in many circles.

13. Denial of three MACP benefits to the Promotees in the Department of Posts

As the promotion to Postal Assistant acquired by writing competitive examination is equated with one MACP promotion, the senior promotees even after acquiring 30 years of service in Postal Assistant cadre could not get the benefits of Rs.4600/- Grade Pay under MACP, where as their juniors are reaching the benefits without any hurdle.

Similarly the Group ‘D’ promoted to Postmen and then appeared for Postal Assistant examination and becoming Postal Assistant could avail only upto Rs.2800 Grade Pay whereas he was earlier availed 4200 Grade Pay under the BCR Scheme. This has caused a resentment among the postal employees and the officials may be discouraged in writing promotional examination if this anomaly is not sorted out. It is requested to kindly consider that in the case of promotees, if they completed 10 years service in the cadre continuously they shall be accorded MACP promotion with next grade Pay.

Further application of bench mark shall be deleted upto pay band II levels as in the Postal there is no provision of review of C. R. entries at divisional level and whatever be the entry made by the divisional superintendent, it becomes final. It is requested to consider deletion of bench mark application in case of officials up to pay band II level in the Department of Post.

<!--[if !supportLists]-->14. <!--[endif]-->Stop harassing staff on Contributory factors for simple and flimpsy reasons by misusing the provision of unbecoming of Govt. servant’ deviating the rules contained in Volume II, FHB etc.

The Directorate guidelines issued vide letter No. 6/8/59-Disc dt. 09.7.1959, 25/44/60-Disc dt. 30.11.60 and 15-9/74-INV dt. 10.02.75 and subsequent orders are being violated and the officials are being proceeded under contributory negligence factors on flimpsy reasons and awarded with huge recoveries. The provisions contained in Rule 106,107,108 & 111 of Postal volume III and the provisions of honest errors can be condoned contained in Rule 204 A (1) Vol. II and the provision of Rule 58, Appendix 4 of FHB Vol. I in dealing of recovery have been totally ignored and sidelined.

The main intention of the Govt. while deciding the degree of an officer’s pecuniary liability , it will be necessary to look not only to the circumstances on the cases but also to the financial circumstances of the officer since it should be recognized that the tendency should not be such as to impair his future efficiency.

We placed this item in the Departmental Council for issuing proper guidelines in deciding, such cases. But it is constrained that the orders issued vide letter No. 14013/03/2010 – VP dt. 22.06.2011 does no mention about all the above said provisions and not a speaking one. Resultantly no one is showing any cognizance to such clarification and innocents are being harassed continuously.

In many cases, the officials at the verge of retirement are being charge sheeted and amount recovered making them as scope goats – The real culprit and main offender become scot free. The main offenders are being dealt with casually. In many places instead of initiating action to recover the amount from the depositors in respect of minus balances, straightaway charge sheets are being issued to recover the amount. The contributory negligence provisions is being misused as a tool against the innocent employees.

It is therefore requested to direct the department to kindly cause appropriate instructions by citing all the above said orders on the subject and to avoid misuse of the provisions.

We seek the intervention of benign Hon’ble Minister of State on the above said items for the immediate settlement of these problems for which we will ever be grateful.
